1. Acceptance

By accessing or using the BookSwap mobile application, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the Service. Continued use of the application after updates are posted constitutes your acceptance of the revised Terms.

2. Description of Service

BookSwap is an online marketplace platform that connects buyers and sellers of new and used books. BookSwap facilitates secure payments through its FastPay escrow system but does not provide delivery services. Buyers and sellers are solely responsible for arranging delivery or meetups.

3. Eligibility

Users must be at least 13 years old to use the application. Users under the age of 18 must obtain parental or legal guardian consent before creating an account. Users are responsible for providing accurate and complete registration information.

4. User Accounts

Users may register using email, phone number, or supported social login providers. Only one active account per user is permitted unless the previous account has been permanently deleted.

Users are responsible for:

  • Maintaining the confidentiality of their account credentials.
  • All activities conducted through their account.
  • Immediately notifying BookSwap of any unauthorized access or security breach.

5. Book Listings

Registered users may list books for sale. Both new and used books are permitted.

Listings must contain accurate information, including:

  • Book title
  • Author (if applicable)
  • Condition
  • Selling price
  • Clear images when required

Sellers are responsible for ensuring that listings are truthful, lawful, and do not infringe upon the rights of others.

6. Pricing and Commission

Sellers determine the selling price of their books. BookSwap may charge service or transaction fees for the use of FastPay or other platform features. Any applicable fees will be clearly displayed before payment is completed.

7. Payments

BookSwap provides secure payment processing through FastPay. When a buyer purchases a book:

  • The buyer's payment is securely held by BookSwap through FastPay.
  • The seller will not receive payment immediately.
  • Funds are released to the seller only after the buyer confirms receipt of the book in the agreed condition, or after any applicable confirmation period if no dispute is raised.

If a dispute is reported before payment is released, BookSwap may temporarily hold the funds while the dispute is reviewed. BookSwap reserves the right to delay or cancel payment releases where fraud, abuse, or policy violations are suspected.

8. Delivery and Meetups

BookSwap does not provide delivery or shipping services. Buyers and sellers are solely responsible for:

  • Selecting their preferred delivery or courier service.
  • Arranging meetups.
  • Paying any delivery costs unless otherwise agreed.

BookSwap is not responsible for lost books, damaged books during delivery, delayed shipments, failed meetups, or courier-related issues.

9. Refunds and Disputes

If a buyer experiences an issue with an order, they must report it before the FastPay payment is released. BookSwap may review available evidence, including chat messages, photos, proof of delivery, and other relevant information.

Based on the review, BookSwap may release payment to the seller, refund the buyer, or take any other action considered appropriate. Once payment has been released to the seller, BookSwap may have limited ability to recover the funds.

10. Communication and Conduct

Users may communicate using chat, calls, images, and voice notes. Users must not harass or threaten others, send spam, attempt scams or fraudulent activities, or share offensive, illegal, or inappropriate content. Violations may result in warnings, temporary suspension, or permanent account termination.

11. Blocking and Reporting

Users may block or report other users for inappropriate behavior. BookSwap may investigate reports and take action, including warning users, removing listings, restricting accounts, or suspending or permanently banning accounts. BookSwap reserves the right to make final decisions regarding reported violations.

12. Prohibited Content

Users must not upload, sell, or share content that violates any law, infringes copyright or intellectual property rights, contains false or misleading information, promotes fraud or scams, contains malicious software, or includes abusive, hateful, or offensive material. BookSwap may remove prohibited content without prior notice.

13. Intellectual Property

All application content, branding, logos, software, and design are owned by BookSwap or its licensors. Users may not copy, modify, distribute, reverse engineer, or reproduce any part of the application without written permission.

Users retain ownership of the content they upload but grant BookSwap a non-exclusive license to display, store, and use such content for operating and improving the Service.

14. Data Retention

BookSwap may retain certain user information after account deletion where necessary for legal compliance, fraud prevention, security purposes, or record keeping. Data handling practices are further described in the Privacy Policy.

15. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. BookSwap does not guarantee successful transactions, accuracy of listings, continuous availability of the Service, error-free operation, or that every buyer or seller will fulfill their obligations.

16. Limitation of Liability

To the maximum extent permitted by law, BookSwap shall not be liable for financial losses, delivery issues, fraud committed by users, lost or damaged books, missed meetups, or indirect or consequential damages. BookSwap's responsibility regarding payments is limited to operating the FastPay escrow service according to these Terms.

17. Termination

BookSwap may suspend or permanently terminate user accounts for violating these Terms, fraudulent activities, repeated misconduct, illegal activities, or any behavior that threatens the safety or integrity of the platform. Termination may occur with or without prior notice depending on the severity of the violation.

18. Indemnification

Users agree to indemnify and hold harmless BookSwap, its owners, employees, and affiliates from any claims, damages, liabilities, or expenses arising from their use of the Service, violation of these Terms, violation of any applicable law, or infringement of another person's rights.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the user's local jurisdiction, unless otherwise required by applicable law. Any disputes arising from these Terms shall be resolved through the competent courts of the applicable jurisdiction.
